Terms and Conditions

These Terms govern your access to and use of CartTell (the “Service”). By creating an account or using the Service, you agree to these Terms.

1. Definitions

  • “We/Us”: [Company/legal entity name] operating CartTell.

  • “Merchant/You”: the person or entity using the Service to run a store.

  • “Customers”: your end buyers.

  • “Website”: carttell.com and subdomains.

2. Eligibility & Account

You must be 18+ and able to form a contract. Keep credentials secure and notify us of any unauthorised use. We may suspend/terminate accounts that violate these Terms.

3. Plans, Billing & Refunds

Subions renew automatically unless cancelled before renewal. Prices exclude taxes; you are responsible for applicable taxes (e.g., SST). Except as required by law, fees are non-refundable and service continues until the end of the paid term. We may revise prices for future terms with prior notice.

4. Payments & Payouts in Your Store

CartTell connects to third-party payment providers (e.g., FPX/Stripe/PayPal). Their terms apply. We do not hold or settle your funds; payouts, chargebacks and KYC are handled by the chosen provider.

5. Your Responsibilities

You are solely responsible for products, listings, pricing, promotions, stock, shipping/pickup/delivery, taxes and receipts, returns/refunds, and customer service. You must comply with applicable laws (consumer protection, e-commerce, PDPA 2010, etc.) and with WhatsApp/Meta policies.

6. Prohibited Use / Content

No illegal, restricted or IP-infringing goods; unsafe/regulated items; hate or adult content; spam or harmful code; attempts to abuse the platform or payment systems.

7. Domains

You may connect a custom domain; you control DNS and renewal. We may reclaim/rename a free subdomain for operational reasons.

8. Third-Party Services

Integrations (payments, messaging, analytics, shipping and others) are provided by third parties. Use of those services is subject to their terms and privacy policies.

9. Data Protection

We process personal data per our Privacy Policy and Malaysia’s PDPA 2010. For business accounts, a Data Processing Addendum (DPA) is available on request.

10. Availability & Support

We provide documentation and support (chat/tickets) during stated hours and use reasonable efforts to keep the Service available. Maintenance or incidents may cause temporary interruptions.

11. IP & Licence

You own your store content. You grant us a limited, worldwide licence to host, display and transmit your content solely to operate the Service. CartTell software, templates and branding are our IP.

12. Disclaimers

The Service is provided “as is” and “as available.” We do not warrant uninterrupted or error-free operation or any particular sales outcome.

13. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or loss of profits/revenue/data/goodwill. Our aggregate liability is limited to fees you paid to us in the 12 months preceding the claim.

14. Suspension & Termination

You may cancel anytime from your dashboard. We may suspend or terminate for breach, unlawful activity, or risk to the Service. On termination your right to use the Service ceases.

15. Governing Law & Disputes

These Terms are governed by the laws of [Malaysia / your jurisdiction]. Courts of [Kuala Lumpur / chosen venue] have exclusive jurisdiction.

16. Changes to Terms

We may update these Terms. Continued use after changes take effect constitutes acceptance.
